Winn Parish Police Jury Apparently Violates Election Laws

The Winn Parish Police Jury apparently committed a felony by paying with taxpayer dollars for the above advertisement in a local newspaper.

From Louisiana’s Constitution:

Article 11:4 – Prohibited Use of Public Funds

Section 4. No public funds shall be used to urge any elector to vote for or against any candidate or proposition, or be appropriated to a candidate or political organization. This provision shall not prohibit the use of public funds for dissemination of factual information relative to a proposition appearing on an election ballot.

From Louisiana Revised Statutes:

LA RS 18:1465 – Prohibited use of public funds

A. No public funds shall be used to urge any elector to vote for or against any candidate or proposition, or be appropriated to a candidate or political organization. This provision shall not prohibit the use of public funds for dissemination of factual information relative to a proposition appearing on an election ballot.

B. Whoever violates any provision of this Section shall be fined not more than one thousand dollars or be imprisoned, with or without hard labor, for not more than two years, or both.

The tax passed, 824 to 391 (68% to 32%), with a turnout of 13.4%, according to the Louisiana Secretary of State.

Eighth Judicial (Winn Parish) District Attorney Chris Nevils said he couldn’t comment, as no formal complaint had been filed.

    It would be interesting to know if the entire jury voted to place this ad in the paper, or if an individual chose to do it. At any rate everyone connected with the illegal act should be prosecuted to the full extent of the law.

    I found this about Avoyelles Parish DA, which applies , I’m sure to Winn DA. The most important duty of the District Attorney is to oversee the prosecution of criminals in Avoyelles Parish. This is in all courts and involves convening the Grand Jury for purposes of deciding which crimes to prosecute. In addition, the District Attorney has wide lattitude in his discretion as to which crime to charge individuals that do not go before the Grand Jury.

    By this it seems the taxpayers have no recourse for felony actions of the Police Jury. Chris Nevils will use the “wide latitude “in his
    decision. It is sickening how elected ones can disregard laws .

    People it’s your money,raise enought stink and maybe somebody will do something. If the da will not act go on to the state level and make more people aware of what’s going on. Remember all of this the next election and vote the bums out.

      DA Chris Nevils was handed 5 counts of malfeasance in office and 1 count of felony theft against former Winn Parish Tax Assessor Bodie Little ( see: ) and he dismissed the case stating it had been too long. It first went to a former DA who died before acting on the case. Yet, it was front page news several years later where Nevils gloated on trying a case that was much older that the Little case.
      Just depends on who it is. Little went on to deplete the Shreiff’s office funds and leave it in shambles. Thanks to Chris Nevils.
      Last Fall he was elected with no opponent.

        That former Winn DA (Terry Reeves) didn’t just die in office. He committed suicide after financial misconduct involving his office came to light.

        Also, former Winn Tax Assessor and former Winn Sheriff Bodie Little is now in prison after being convicted in federal court of trafficking drugs while sheriff.

        Winn Parish government is exceptionally corrupt even by Louisiana standards. Nobody gets held accountable until the state or federal investigators or prosecutors step in.

    A complaintant should be able to file to have the election voided. It may not work but the complaint should be lodged. This will cost alot of money to re-run the election but should also shed much light on the ignorance of the law on the part of the jury, making it less likely that the tax proposal will win.

    It is no accident that tax elections happen while the populous is sleeping and the ballots are crowded with pablum. An election over a single tax is still easy but it is harder to pass. If the media does its job and explains why the election is being re-run, maybe they can push to interview a police juror about their ineptitude and watch them spin/squirm explain the excrement on their shoe into which they have stepped.

      RE: Illegal Activity of Winn Parish Police Jury

      Just before the tax election held May 2, 2015, the Police Jury of Winn Parish published an ad in the Winn Parish Enterprise -News American urging voters to vote,“YES” for the tax. That is clearly in violation of the Constitution of the State of Louisiana ( Article 11: 4 and LA Revised Statute 18:1465

      Concerned citizens ask state officials to pursue charges of said Police Jury members for their illegal act. Our District Attorney, Chris Nevils has a conflict of interest as he is legal council for the Jury. We need you help.

    Just a random thought…
    Could the police jury members took their own personal money and paid for the add? Then added the wording at bottom to say paid for by Winn parish jury. It could be that personal money not police jury funds that paid for add.why not contact the jury members to ask before jumping the gun on finger pointing

      The plain wording of the ad says it was paid for by the Winn Parish Police Jury, not by individual police jurors out of their personal funds.

      I think it would be a good idea to question the police jurors about this, but we should remember that police jurors who would commit a felony by spending public funds illegally on this ad would probably also lie to defend themselves from the consequences of their illegal acts. Rather than taking their word for it, investigators should look at the paper trail to see who was billed for the ad and where the money was paid from.

      Were a juror to take his personal funds and then tag an ad with “paid for..” he would be in violation of more than the rules cited.

No more fat cat politicians,just people that wanted to serve for the betterment of their community. Winn Parish has long been known for its slick politicians,it’s time to change. Oh I bet they will say” it’s for the Parish and nothing more”. Look and see where the money goes and then you will have your answer.

    DA Chris Nevils was rewarded after his Jan. 21, 2009 drunk driving episode with his election to the Board of Directors of the Louisiana District Attorney’s Association.(Winn paper 8//5/09).
    E.Pete Adams, executive director of the Louisiana District Attorney’s Association, had earlier issued a statement printed in the Winn paper Feb 4, 2009, stating Nevils arrest won’t limit him from acting as the parish’s district attorney. All that shows the character of men in the DA Association. They don’t think there is a need for one of their own who broke laws and his Oath of Office he took, with his hand on the Holy Bible, to be barred from keeping on receiving pay from us taxpayers.
