The Town of Jonesboro’s Attorney and the Rules of Professional Conduct

Monroe attorney Carol Powell-Lexing may be getting close to a violation of Louisiana’s Rules of Professional Conduct for attorneys. She had some pointed remarks about Second Judicial (Bienville, Claiborne, Jackson parishes) District Court Division B Judge Jimmy Teat’s ruling last week in the matter of State v Jonesboro.

Town attorney Carol Powell-Lexing called the judgment a “racial and political takeover” of the town. She plans to file a motion with the 2nd Circuit Court of Appeal Wednesday.

“For political reasons we anticipated the judge would rule against us. We’re ready to roll to fight this racial, political takeover,” Powell-Lexing said.

Here is the pertinent rule:

RULE 8.2. JUDICIAL AND LEGAL OFFICIALS

(a) A lawyer shall not make a statement that the lawyer knows to be false or with reckless disregard as to its truth or falsity concerning the qualifications or integrity of a judge, adjudicatory officer or public legal officer, or of a candidate for election or appointment to judicial or legal office.

    II would hope the Court and the Sitting Judge at that time. If this is not a violation, don’t know what is. I hope she gets a hefty fine. She deserves it after that and other remarks she has made.

    Sounds like the mayor made another poor choice for legal representation. If that is all that they can base the appeal on, I predict the appeals court judge will not even take the case.

      Uh oh……is the appeals court judge of a particular color or registered to vote with a particular party or does he or she part their hair on a particular side and do they own a particular make or mode of car? We can already guess what the comment to any judgement that judge might render…….it starts with an r and ends with a t and , bet you can’t guess it!

    And certainly since the Mayor is paralegal (like a lawyer) he would certainly know if she is doing her job or not.

      A paralegal is a glorified gopher. Period. End of discussion. A paralegal can’t try cases before the court. The CTIC must be watching a lot of lawyer shows on the boob tube and thinks he can handle himself in court. A paralegal (like a lawyer)! That has made my day.

          “Informaiton” Says: I have never defended the CTIC (chief turn in charge) Thompson. He has taken Jonesboro down a road that leads to oblivion and (in my estimation) taken quite a bit from the town. That $70,000 salary, I feel, is not the only thing he has taken. An audit should show tons of mismanagement and possibily a lot of money they can’t account for. To say that I defend him is f***ing nuts. He lacks any qualification for the job that he holds, and I would suggest that he seek employment at the local McDonald’s where is stupidity might be appreciated. Don’t ever tell me that I have defended that asshole. As for the water in Saline Lake, I just might try it the next time I am down there as the fish sure as hell weren’t biting.

    Anonymous of 6:35 a.m. asks if anyone can have an opinion and express it. All you have to do is re-read the rules of professional conduct at the head of this blog to see that attorneys are held to a higher standard than the average person. You or I could probably get by with questioning the integrity of a judge, but you can bet that if this attorney continues to do so, especially to a news or TV reporter, some judge is not going to take kindly to it, and will use all means at his disposal to properly discipline the person who made them.

    My question is: Why would an attorney make such statements? What did she hope to gain by them? The judge is not going to change his ruling because of them, everybody who reads them will agree with her remarks or disagree based on what they thought befoe she made them, and if she is trying to influence the appeals judge (whoever he may be), that is not the best place to do so. The courtroom is the place for any evidence she has that what she says is true to be presented.

      The loud mouth tactic has prevailed up until now, videos all over the internet, and on the blog by the town employee, accusing everyone of racism and violation of their rights, it has worked up till now. No one has done one thing to see that the issues were dealt with in a court of law, period. Until someone takes it to the judicial system to deal with it judicially, it will continue, and they will keep shouting to the high heavens and using any method or means available to cry their issues before God and man. The most amazing thing yet was the interview last week where he said the Judge should realize he needed to lay aside petty things and uphold the law, what a hypocrite. He and his puppeteer define PETTY.

    Thompson and his lawyers are certainly not doing anything to make them popular with the judges in north Louisiana. Don’t worry, they are human and they do read these comments, even though they are about their fellow judges.
    What was surprising about the “kangaroo court” remark was that Dill would put it on his website. He almost got his boss in a peck of trouble.

    We better hope that Thompson and the Town Council keep the same lawyers. They are never going to win a case with that attitude: “Sorry, your honor, but we don’t have anything to offer except charges of racism, and we know you are not going to rule in our favor on that.”

    Don’t worry, they will keep them because they are doing just what Thompson and his little “inner circle” want, that is to blame everything on race, whether it is good courtroom strategy or not. That is why he picked the lawyers he did.
    He thinks because it worked so well for him in Jonesboro, all people of his race will support him, no matter how many mistakes he makes. We will see.

    Lawyers pick their clients, except in the case of indigent defenders or state appointed attorneys. These may have been the only ones he could get to take his case.

    I am sure that racism never existed in Jonesboro Louisiana. Hundreds of years with white mayors running the town and I am sure that they never did anything that would cause the State to take over the decision making authority of the mayor. With the election of a black mayor within 5 years there have been at least 30 allegations of wrong doings by the mayor. Hundreds of years with a majority white city council I am sure the town ran smoothly with no need for the Attorney General to seek to usurp duly elected town official’s .right to govern the citizens who elected them in a democratic election. Now with a majority of Black city council less than a year later the State finds it necessary to execute a hostile takeover of the city of Jonesboro.
    When blacks were being lynched and denied the right to exercise their right to vote n Jonesboro, Louisiana; victim of these racist tactics requested help from state officials. The perpetrators of the lynching and the officials who were denying black citizens the right to vote and their supports called the efforts of outsiders, “undemocratic interference with local government”. State officials did nothing and Blacks had to take matters in their own hand. In 1964 the Deacon of Defense was founded in Jonesboro Louisiana because state officials refuse to take control of local authorities and racist groups refused to follow the law and openly practiced acts of violence and segregation based on race to the detriment of Blacks. Local officials and their supporters intimidate the Black community with a campaign of terror. A group of Black men in Jonesboro, Louisiana led by Earnest “Chilly Willy” Thomas and Frederick Douglas Kirkpatrick founded the Deacon of Defense in November 1964 to protect civil rights workers, their communities and their families, against the violence being perpetrated by the white community.
    Nearly 50 years later the Mayor’s Office and the city council is being occupied by black citizens for the first time in Jonesboro’s history and the State officials have now found it necessary to take over. I am sure that this is just a coincident and it has absolutely nothing to do with race. I am sure that the Honorable Judge who has never ruled in favor on the city of Jonesboro since this sad saga began is color blind and is just as fair and impartial as the judges 50 years ago. I applaud the frank statement of Attorney Lexing. You do not give up your right to freedom of speech when you enter into a profession. I also applaud the frank and revealing statement of the citizen of Jonesboro who called Jonesboro City Council members and the mayor, “Niggers”. The judge hides behind a black robe and the State Attorney General hides behind a title when both of them ought to simply join the choir with the honest citizen of the council meeting who simply called the Jonesboro elected officials, “Niggers.”

      Wonder how many more appeals will be filed since we have a Fiscal Administrator? I am sure he will not approve using town funds to support Leslie’s unfounded allegations of racism. Racism did not make the town go into financial arrears, it was the management of money and the inability to distinguish between revenues and reserves (certificates of deposits). I am sure the appeal wagon is slowly coming to a halt and I am just guessing that Carrol Powel Lexington will be finding themselves more preoccupied with other clients. They also may find themselves in the list with others that have not been paid.

      I am confused as to how to connect the dots from Mrs. Roberts to the missing money and the inability to balance a budget?

      “Hundreds of years”…sorry Rev…..Jboro has not been around for Hundreds of years to have a white mayor and council.

      Yes, I do believe the first settlers were white and the community was settled AFTER all slaves were freed.

      So go ahead and try to make it sound like the history you want it to be.

        She is taking all she can obtain for her non-profit and then taking it for herself!!!

        Her brother is a preacher and they are from the south.

        She stirs up race issues. This is an attempt to keep the spot light off her and those grants she “takes” for helping so many others…..now, I do know the grants help her family very, very much.

        Living large ….look at their housing, kid’s private school, trips, cars…….check out the facts!

        Lot of living like a rich woman off the tax dollars gathered and given to improve lives of less fortunate folks….what a shameful situation.

        Oh, and check out her pride and sense of self worth?

      Budget is revenue less expenses.

      This is real simple accounting practices that no one at City Hall in the past few years has been able to grasp or understand….based on the TRUTH.
