Law Ordering Contract Trash Pick-Up for Ouachita Residents @ OPPJ Monday

Ouachita Parish Police Juror (OPPJ) Pat Moore (District F) will introduce an ordinance at Monday’s OPPJ meeting to require:

The owner of every occupied residential rental unit in the unincorporated area of Ouachita Parish shall maintain a contractual arrangement that provides for the collection, conveyance, and disposal of solid waste from such commercial building by a franchise agent on a regular basis of not less than two (2) times per month. The obligation of the owner may be satisfied by a contractual arrangement maintained by the occupant of such residential rental unit.

The penalty for non-compliance:

The violation of any of the provisions of this article or rules and regulations promulgated thereof shall be deemed to be and is hereby declared to be a misdemeanor and any person convicted of the violation thereof shall be fined not more than one hundred dollars ($100.00) or ordered to perform not more than 40 hours of community service, or any combination of such penalties.

The meeting is set for 5:30 PM, Monday, March 4, Ouachita Parish Courthouse, second floor.

Also, a public hearing is scheduled on an ordinance introduced at the 2/19/13 meeting that would provide for penalties for derelict property and trash. The final vote on that proposed ordinance will take place during the regular jury meeting.

    And so it begins. The Affordable Care Act mandates that Americans must purchase insurance or pay a penalty. Now the OPPJ is mandating that citizens contract for trash pickup or pay a penalty regardless of their circumstances. ObamaCare opened the floodgates to direct government mandates on citizens. The Constitution specifically forbids bills of attainder which are legislative acts declaring a person or group of persons guilty of some crime and punishing them without privilege of a judicial trial. Passing laws that force Americans to make purchases against their will or levying fines without benefit of a trial is certainly a bill of attainder, and an unconstitutional abridgement of liberty at the very least!
