The Louisiana Supreme Court has denied the Town of Jonesboro’s petition for a Writ of Certiorari (application for review) of two civil cases – Essmeier v Jonesboro and State of Louisiana v Jonesboro – according to a 1/23/13 press release from the court.

The town had appealed both cases to Louisiana’s Second Circuit Court of Appeal last year, and both were denied by that court on December 19, 2012.
Essmeier v Jonesboro concerned the proper procedure for amending the town’s budget, and State v Jonesboro was about the appointment of a Fiscal Administrator to oversee the town’s finances.

Chief Justice on LA Supreme Court is black. He must have seen it as a “green” issue just like the Legislative Auditor’s and Attorney General’s office and most of TOJ, the intelligent side of the town anyhow.
Mayor, you called Judge Teat a “racist” and that he ran a Kangaroo Court. Mayor, who is the “racist” here since the “highest court” in Louisiana upheld Judge Teat’s ruling. Surely the “good” people of the TOJ who stood up against you or the Court of Appeals or the LA Supreme Court are not racist, they are just law abiding citizens. How many lawsuits have you won in your 5 years as mayor? 0-5 That record would get any coach fired.

In the mayor’s own words “too much has been spent on attorneys fees”. Mayor, LaStevic, Devin and Charla, you owe the TOJ thousands of dollars in attorneys fees and overpayment of the mayors salary, You voted what the mayor told you to vote now pay the price. Loyalty has its costs. I hope the “dogs” make you pay up since you are in contempt of Judge Teat’s order.

Just a little FYI…. when the current Louisiana State Supreme Court Chief Justice, Catherine D. Kimball, retires this month…her successor is another extremely smart lady, who is Bernette Joshua Johnson. Both our current and future chief justices are women.

Judge Teat’s ruling was that “NO” amounts were to be dispensed under Ordinance No. 701 retroactive to March 2011. He ruled that Ordinance 701 was illegally implemented and was not valid for the current and future. This order was against the mayor and council members Cottonham, Flowers and Mason and any TOJ Clerk.
The mayor never got another Ordinance passed to give him a raise so any money he has received in excess of the Ordinance that was in place at the time is owed back to the TOJ. Mayor, you want what you owe payroll deducted right? This includes illegal payments on the mayors behalf to the retirement system!
I believe Renee is safe from owing anything to the TOJ since she voted against the Ordinance and the future budgets that included the mayor’s raise. Sam, your goose may be cooked with the mayor and other council members. That’s a lot of dough you council members owe since you know the mayor doesn’t have anything.
Further investigation needs to be made to determine if the mayor and council members owe 50% of the attorney fees for fighting this legitamate suit. Hope Attorney Culpepper looks at the law on this one. TOJ may get enough from the mayor’s council members to paint the watertank.

Here is a thought – Have the legal people get with the Mayor and his “Yes” people and offer them this deal. If you quit your jobs and step aside gracefully we will forgive what you owe the town of Jonesboro with this stipulation – none of you will ever again seek an elected position any place in Jackson Parish. They will have to take their chance on any legal action brought against them for stupidity in office. It would be so nice to see their asses walking out the door of City Hall for the last time. Just a thought!

The mayor has been quoted as saying that too much money has been spent on lawyers and legal proceedings. He has also mentioned on TV a round figure, but never has divulged to the public exactly how much. This should be a public record required for him to furnish by a certain date, listing to the penny (would be a lot of pennies) how much has been spent in several categories: defending a charge, objections to the legality of the charge, appeals and appeals of appeal rulings. That would show how much taxpayers’ money has been spent without them having anything to say about it except through their elected town council members, and except for one, that is not saying much. .

Let’s see, that would come to about $8,749.50 refund not counting interest accrued. Pretty good chunk, the Town can certainly use it. Let’s hope he doesn’t squander it on some wild idea that he can get the council to pass, or find a legal way to funnel it back into his pockets.
