2nd Circuit Rules on Interim Motions

Louisiana’s Court of Appeals, Second Circuit has ruled on a couple of motions made by the defendants in the case Louisiana v Jonesboro, and both motions were denied.

Denied was a defense motion for contempt against the Jackson Parish Clerk of Court. The motion asked that the clerk be directed to furnish court records and a trial transcript from the July trial that resulted in the appointment of a fiscal administrator. At issue is payment for the record and transcript.

Also denied was a request for an order from the court directing the clerk to provide the transcript.

Complicating matters for defense attorney Carol Powell-Lexing is that their brief was due to be submitted by last Friday, October 12. Toward that end, Powell-Lexing has filed a Motion for Extension.

Also, the 2nd circuit has docket oral arguments in the case for November 12.

    So, in other words, their lawyers did not even get the paperwork filed in time. Instead, filed for an extension. The bad thing about cancer is, you can put off going to the Dr. as much as you want. In the end though, it wont make you live longer.

    Please go back and review the testimony of Mr. Vallan on October 2, 2012 before the Fiscal Review Committee, he stated there had been issues with costs associated with the payment for the transcript-”that has been resolved”, which part of this story is missing? I don’t think you have all the facts, yet.

    The mayor can pay for the transcripts just like he did on the last one…

    Alma Brashear was paid with a sewer repair fund check …if I remember correctly.

    Besides, if the Mayor’s attorneys felt the town was exempt from paying, why pay the first time?

    Mayor may need a concert or carnival for some fast cash.

    Attorneys usually do not work for IOUs.

    Guess the weekly visit to the churches didn’t raise enough funding to get the job done. Hear tell it, they too have grown very weary with the begging for legal fees.

    Wonder where the Love Bug has been lately, the standard bearer has been conveniently absent as of late. Wonder why he don’t file all the necessary paperwork, since he is a Dr.

      I hope they have truly grown “weary” of the beggars soliciting more of the green stuff. Trouble is, they will NEVER stop begging for mo and mo funds to pay for this mess they created.

      As for that attorney from Monroe……….this is so very typical of her. Extension needed? Why does she not get her work filed in a timely manner? Just another case of not being on top of things.

      what a joke, he among many others have worn the wheels off the town’s vehicles……….just depends on who was doing all the driving at the time as to whether or not it was against the law. Selective enforcement, that’s what Jtown is all about…….just who you suck up to and how muck you kiss as to what happens to you.

      Wasn’t there supposed to be some kind of restraints on ol’ Les’s use of the Bat Mobile……oops…..A-1 car when the FA came on board? He still seems to be rolling, rolling, rolling on down the highway to a sundry of who knows what and where. I see him ALL the time headed out of town at break neck speed on the 4-lane highway.

    Can’t believe that the fiscal administrator will authorize spending taxpayer’s money for all these frivolous objections, motions and delaying tactics. That means the mayor and council will have to come up with some means of paying it if they want to keep expensive out of town lawyers instead of the local town lawyer.

    I, like many of us, had high hopes at the news of the fiscal administrators arrival on the scene. I have since learned that this too was a major disappointment! Nothing has changed and the FA obviously can not get anything done due to “lack of cooperation” on the town’s part. Well did we really think the FA would walk in here and the mayor would just openly give and help the FA move him right out of office? It should have been known he would be working against great oposition! Obviously the FA has started even doubting him self at what changes he will be able to make. No, looks like once again we were lead down a dead end street!

      I disagree, the hemorrhaging of tax dollars has been restricted and some people have been required to provide written evidence of expenditures, as was the testimony at the Fiscal Review Committee. If nothing else, it has proven beyond a shadow of a doubt that debacle of the Town of Jonesboro falls soley and squarely on the shoulders of the Mayor-Mr. Leslie C. Thompson, no one else but him.

      It also proves everything that one particular person tried to get help with for over 5 years.

      Lastly, it proves that there could have already been arrests made, but everyone with the authority to do that has no courage, they would rather sit back and watch the town implode, use the convenient excuse that you just have to let it go down instead of doing their job. Pathetic excuses all of them from the top to the bottom-Thompson is no worse than the ones that won’t do their job either, he just gets the limelight while they hide in the shadows.

      Just like the mess in Gibsland, Ringgold, the same man could have already done his job in those places as well but he is useless. At least our Sheriff is doing his best and won’t hesitate to make an arrest and let the others make excuses why they turn them loose.

    Is that so? Someone might want to ask around a little more as to just exactly why there were no charges filed over the town property at the lake incident.
    I think you just might be suprised at the answer. Also at who requested there not be an investigation. Go ahead, dig a little.

    Let’s ask Mitt the Twit and Paul Ruin for their opinion on the crap that is going down in Jonesboro. No, no, no. That is not a good suggestion. All they would say is “let Jonesboro go bankrupt” (you know, like the auto industry). Sounds like the people who could do something are repugnicants and are satisfied to let the town go down the toliet as long as they can steal what they can. Why can’t the State Police be contacted and made aware of all of these charges? Couldn’t they do something? Why not ask Rodney to get some stimulus money and put it in Jonesboro to help save the situation? Oh, wait! He’s a Tea bagging repugnicant and will do what he is told by his leadership. There are very qualified and very
    intelligent blacks that, if they were mayor of Jonesboro, could do a better job than this piece of horse dung the town has elected twice.     The state police did look in to it. Know what they found? Nothing! All they found was evidenceon top of evidence of incompetence. Unfortunately, incompetence is not illegal. Everything that was discovered only showed that no one knows what they are doing. Nothing could be found that indicated intentional wrong doings. The problem with that is you have to show intent for there to be a crime. No intent could be found.
    As much as I hated to hear it too, there was no evidence. Jonathon Stewart is taking all the heat, when others wont stand up and say, “we dont have anything.” The incident with the town property at the state park was overlooked for the fact that it was asked of Stewart to ” not look to deep into it, because if you do, you will find that we are all guilty of helping churches.”
    I hated hearing alot of what I heard because just like you, I want the crooks brought down also. But people, we have all got to open our eyes and see that it is not only city hall and J. Stewart that are lying to us.

      can you please go back and get a better bag of excuses? there is plenty of evidence, has been all along. So your statement that says we all have done it too, is that supposed to make it “legal” just because everyone has broken the law, it’s supposed to be overlooked?

      that has got to be the most bizarre excuse yet, every other Parish in North Louisiana has elected officials prosecuted regularly because the “all do it” not let them continue on because of the fact that they ” all do it”.

      now incompetence is the new excuse, they know full well what they are doing and the excuse of I didn’t know has worn very thin.

      since when did a request to over look illegal activity replace enforcing the law? if you do over look it you are as guilty as the one that broke the law.

      is it supposed to be acceptable because more than one group of people are misrepresenting the truth, again just another excuse.

      why not just try a new approach, do your job, arrest people for breaking the law instead of making excuses for why they shouldn’t or couldn’t be arrested and prosecuted. Ringgold, Gibsland, Arcadia, and now Jonesboro? the law was written to enforce, not make excuses for why you are willing to look the other way just because a group of people are breaking it.

      the people’s eyes are open and focused on the facts at hand, and everyone that has had a hand in covering up for the people involved in every single aspect of this entire mess called “incompetence” will answer one day, perhaps not here, but one day it will all come forth.

      sad to know that some people will sell their soul for a vote, but since “everyone does it”, it’s ok” .

    I totally agree with you 100%. That was the complete purpose of the comment. I am not the one making the excuses. I am simply repeating what was said. A certain official is the one that asked for it to be overlooked, not me. I honestly agree with the part of the law that states Ignorance is not justiification.
    I’m simply repeating what a handful of people,that actually know some facts, are scared to repeat. 95% of the people in Jonesboro think they have all the answers and think thet know the facts. Truth is, you don’t. I probably should not be repeating them either. But, I am so sick of the lies. Some people think that it is cover ups and mistruths going on. Then there are the others that think the conspiracy theories are ridiculous. Well, they are the ones that are wrong this time. The lies and the “cover ups” go way further down the line than Stewart. Call me what you will. Someone that is on the mayor’s side or whatever. I assure you that is not the case. I am the one that thinks that every single official that did not do their part in stopping this is just as guilty! Hence, the exact reason for these posts.
    To Jonathon Stewart,
    Quit taking the heat. I know, what you and a few others know. Why don’t you quit letting the weight fall on your shoulders. Tell the people the truth about their “only hope”. Tell them how he asked you not to investigate the lake incident. It is absurd Mr. Stewart that you remain the fall guy for this. I think the people deserve to know that the one they all have so much faith in is, behind closed doors, letting them down.

      They dont want to open their eyes and see the truth. I said the same thing last year, Leslie has incompetent people in his circle, but he hasn’t done anything illegal. The one that they have so much faith in to “clean the mess up” is playing both sides of the fence. This person wont put that huge salary in jeopardy. So this person tells the people “that want blood” the DA wont do his job, then gives Leslie a wink when he sees him. It’s politics baby, nothing personal!!

    I don’t doubt at all that the DA was advised by a high official, perhaps more than one, “not to do anything.” But Mr Stewart’s
    responsibility is to the public that elected him, and there was no way any official could force him to do anything. “The buck stops here,” and in this case it is the DA.
